Terms of Service

These terms set out what Siam Butler does, what we do not do, and the basis on which we work with you. They apply to anyone who contacts us through this site, books a callback, or engages us for any of our services. Please read them — particularly the sections on third-party services and limitation of liability — before instructing us. If you don't agree with them, please don't proceed with an engagement.

Who we are

Siam Butler is a referral and advisory business registered in Thailand, with its office at 110 Phetkasem Soi 140, Hua Hin 77110, Prachuap Khiri Khan, Thailand. References to 'we', 'us', and 'our' in these terms mean Siam Butler. References to 'you' mean the person or organisation engaging us.

What we do — scope of services

We provide three categories of service: (1) health insurance brokerage and advisory for individuals, families, and companies, including help with applications, renewals, and claims; (2) visa application support, including eligibility checks, document preparation, translation, notarisation arrangement, and immigration-office liaison; and (3) referrals to independent Thai law firms regulated by the Lawyers Council of Thailand, with optional translation and coordination on top of the referral. The exact scope of each engagement is set out in the written quote we provide before any chargeable work begins.

What we are not

We are not a law firm and do not provide legal advice. We are not an insurance company and do not underwrite or pay insurance claims. We are not a government office and do not grant visas, residency, or work permits. We are not a tax adviser or financial planner. Where our work touches any of these areas, we either refer you to the appropriate licensed party or facilitate your dealings with them — we are not the contracting party for the underlying outcome.

Engagement and instructions

An engagement begins when you accept a written quote from us in writing (including by email or messaging app). Until then, no obligation to perform work and no fee arises. We may decline to take on, or may end, an engagement where we believe the work is outside our competence, against the law, or against the interests of another existing client.

Third-party services and your relationship with providers

When we help you obtain insurance, a visa, or legal advice, the underlying contract is between you and the third-party provider — the insurance company, the relevant Thai government office, or the law firm. They are independent parties responsible for their own services, decisions, conduct, fees, and outcomes. Siam Butler is not a party to those contracts and is not responsible for the services those parties provide, the decisions they make, the outcomes they reach, the timeframes they keep, the quality of their work, or any loss or damage arising from them. Where we recommend a provider, the recommendation is given in good faith based on our experience at the time, and is not a guarantee of any particular outcome.

Fees and payment

Service fees are quoted in Thai baht and are exclusive of government fees, third-party fees, applicable taxes (including VAT), and out-of-pocket disbursements unless the quote explicitly states otherwise. Government fees and third-party disbursements are passed through to you at cost. Invoices are payable on the terms stated on the invoice. Late payments may attract interest at the Bank of Thailand reference rate plus 5%.

What you agree to provide

You agree to give us complete, accurate, and timely information and documents needed for the engagement; to disclose anything material that we ask about (medical history for insurance, prior visa or criminal history for immigration, conflicts of interest for legal); and to inform us promptly of any change in your circumstances that affects the engagement. We are entitled to rely on the information you provide without independent verification, and are not responsible for outcomes that change because that information turns out to be incomplete or inaccurate.

Limitation of liability

To the maximum extent permitted by Thai law: Siam Butler's total cumulative liability to you for any and all matters arising from or in connection with our services — whether in contract, tort, statute, or otherwise — is limited to the fees actually paid to us for the specific engagement giving rise to the claim. We are not liable for any indirect, consequential, special, or punitive damages, or for loss of profit, revenue, business opportunity, goodwill, or anticipated savings. Nothing in these terms excludes liability for fraud, fraudulent misrepresentation, or any liability that cannot be excluded by Thai law.

Outcomes outside our control

Insurance underwriting decisions, visa approvals and timelines, immigration office requirements, court schedules, and the actions of third-party providers are outside our control. We do not warrant any specific outcome, processing time, or result from these parties. Estimated timelines we share are based on our experience and are not commitments.

Confidentiality

We treat the information you give us as confidential and use it only for the engagement, subject to our privacy policy and any disclosure required by law or regulator.

Termination

Either party may end an engagement on reasonable written notice. Fees for work already performed remain payable. Out-of-pocket costs we have incurred on your behalf remain payable. We will return your documents and provide a handover summary on request.

Governing law and dispute resolution

These terms are governed by the laws of the Kingdom of Thailand. Any dispute arising out of or in connection with our services will first be addressed by good-faith discussion. If unresolved, it will be referred to the courts of Thailand having the appropriate jurisdiction over Hua Hin. Nothing in this clause prevents either party from seeking interim relief from a competent court.

Changes to these terms

We may update these terms when the way we work changes. The version that applies to your engagement is the version in force on the date the engagement is accepted, and is preserved in your engagement letter for reference.
